The rights and remedies that are available to you if your child is being bullied depend on the bullying that is happening. For example, if your child is being physically bullied, the liability could be criminal. If it's physical, it could be assault and battery, at which point, you should contact the police. If the bullying verbal or emotional, especially if it's making fun of a child for something they can't change; for example, their race, the way they look, if they are disabled, or if there is something different about them, their sexual orientation, then you are getting into an area of much bigger exposure. That could be negligence for the school district and for parents if there is a systemic problem that is not being addressed. The third exposure would be if children are using the internet. It is very common to use Facebook to be mean to each other. If Facebook is involved and it is a systemic problem that has not been addressed by the school, at that point, there could be a Federal cause of action. You would really need to speak to an attorney about the specific things going on with your child, but there could be several courses of action and several levels of defendants. Hopefully, if an attorney gets involved, the issue will be resolved before it gets to the courts.
